These Terms of Service ("Terms") constitute a legally binding agreement governing the use of the Wunbek and Wunbek Business mobile applications ("App"). By downloading, registering, or using the App you agree to these Terms.
1. Parties
- Service Provider: Ferhat Demir (Operator of the Wunbek brand)
- User: Any person who downloads or uses the App
2. Service Description
Wunbek provides a platform that allows users to discover, compare, review, and book online appointments with beauty, hair salon, barber and clinic service providers. Additionally, the App offers:
- AI-assisted style recommendations
- Campaigns and loyalty program
- In-app chat with salons/businesses
- Treatment and patient management panel for clinic businesses (Wunbek Business)
- Push notifications and appointment reminders
3. Account Creation and Use
3.1. Eligibility
- You must be at least 18 years old. Users under 18 may use the App only under the supervision and with the permission of a parent/guardian.
- You are responsible for the accuracy, currency, and completeness of the information you provide.
3.2. Account Security
- You are responsible for keeping your account password confidential.
- If you detect suspicious access, notify wunbek@gmail.com immediately.
- A single user account may not be used by more than one person.
3.3. Prohibited Conduct
The following are prohibited:
- Entering false information or impersonating another person
- Posting content containing insults, harassment, or discrimination
- Leaving fake reviews or ratings for salons/businesses
- Reverse-engineering, decompiling, or probing the App for vulnerabilities
- Using spam, automated scripts, or bots
- Collecting other users' personal data without consent
- Uploading content that infringes copyright
4. Appointments and Cancellation
4.1. Booking
- An appointment request is not binding until confirmed by the salon/business.
- The user is responsible for selecting the correct date, time, and service.
4.2. Cancellation
- The user may cancel free of charge at least 2 hours before the appointment.
- Late cancellations or no-shows are subject to the salon/business's own cancellation policy.
- In the event of repeated no-shows, Wunbek may temporarily or permanently suspend your account.
4.3. Cancellations by Salon/Business
If the salon/business cancels the appointment, you will be notified. Booking an alternative appointment is at the user's initiative.
5. Payments
Currently, payments are not collected through the App; payments are made directly with the salon/business. The following terms will apply to future payment features:
- Payment is processed through a PCI-DSS compliant third-party provider (e.g., iyzico, Stripe)
- Your card information is not stored on Wunbek servers
- Refund policies are subject to each salon/business's own terms
- In-app purchases (premium, etc.) are subject to iTunes or Google Play store rules
6. Additional Terms for Business Users (Wunbek Business)
6.1. Registration and Approval
- Business registration is reviewed by Wunbek and documents (tax certificate, business license) may be requested when necessary.
- Unapproved businesses are not displayed in the App.
6.2. Patient Data (Clinic Modules)
- The clinic business is the data controller of patient data.
- Obtaining patient consent and compliance with KVKK/GDPR obligations are entirely the business's responsibility.
- Wunbek only serves as a data processor providing infrastructure.
6.3. Commission and Fees
- The App is currently free.
- Any future commission structure will be notified to businesses at least 30 days in advance.
6.4. Termination
- A business account may be terminated by Wunbek in cases of: false information, repeated poor reviews, legal violations, missing tax/business licenses.
7. Intellectual Property
- The Wunbek brand, logo, App interface, source code, and design belong to the Wunbek operator. They may not be copied, distributed, or sold without permission.
- Content you upload (profile photo, review, AI Stylist photo) belongs to you. By sharing it through the App, you grant Wunbek a worldwide, royalty-free, limited license to use it in connection with the App's services.
8. Disclaimer of Liability
- Wunbek is not responsible for the quality of services provided by salons/businesses.
- The App is provided "as-is". No warranty is given that it will operate uninterrupted or error-free.
- Wunbek shall not be liable for damages arising from technical issues, server outages, or failures caused by third-party services (Google, Supabase, Firebase).
- AI Stylist suggestions are for entertainment and inspiration, not professional advice.
9. Indemnification
You agree to indemnify Wunbek for any damage caused to Wunbek or third parties as a result of your use of the App in violation of these Terms.
10. Account Suspension and Termination
Wunbek may suspend or permanently close your account without warning in the following cases:
- Breach of these Terms
- Illegal activity
- Harm to other users or businesses
- Fake account / identity spoofing
When your account is closed, data you uploaded will be deleted in accordance with the Privacy Policy.
11. Changes
We may update these Terms. Material changes will be announced via in-app notification or email. Your continued use of the App after changes means you accept the updated Terms.
12. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Türkiye.
- In case of disputes, the courts and enforcement offices of Istanbul, Türkiye shall have jurisdiction.
- For consumer users, consumer rights under Law No. 6502 on the Protection of the Consumer are reserved.
